PROVINCIAL ASSESSOR NG AKLAN AT MUNICIPAL ASSESOR NG MALAY PINADIDISMISS NG OMBUDSMAN

Narito po ang disclosure na inilabas ng Boulevard Holdings, Inc. (BHI) sa naging desisyon ng Ombudsman sa isinampa nilang kaso laban kina Kokoy Baladjay Soguilon, Aklan provincial assesor at Erlinda Tumaob Casimero.

SUBJECT OF THE DISCLOSURE

Fire Out Decision by OMBUDSMAN. We copy you hereto the recently mailed OMBUDSMAN DECISION —upgrading from NEGLECT OF DUTY to GRAVE MISCONDUCT to violate the law—to fire from office the Provincial Assessor of Aklan and the Municipal Assessor of Malay, forfeiting their full retirement benefits as well as banning them in perpetua from holding any public office.

Decision for the ADMINISTRATIVE CHARGE and Resolution for Criminal Charge.

BACKGROUND/DESCRIPTION OF THE DISCLOSURE

The cause of this action is BHI’s Fridays Holdings, Inc. subsidiary’s complaint against these government officials for:

1) refusing to issue a proper 2015 tax declaration update of ownership by Fridays Boracay, and instead showing a bogus loan of several billions on the Tax Declaration and showing Mila Yap again as owner;

2) refusing to certify our 2014 Tax declaration, issued by the same assessor, showing us as owner of the 1,500 sq meters of land we bought from Mila Yap and family in 2009;

3) and conniving to dishonor our duly paid BIR Certificate Authorizing Registration (CAR) after paying 5 million in transfer taxes and their act to cancel our 2014 Tax Declaration of ownership of the parcel;

4) they used as an excuse the change in Assessment value from 2014 to 2015 as the reason to cancel our duly transferred ownership and 2014 Tax Declaration and give back ownership to Mila Yap and her allies.

In the meanwhile both Assessors stated until 2016 that the Tax Declaration showed Mila Yap as owner still.

NATURE AND DESCRIPTION OF THE LEGAL PROCEEDINGS
Decision for the ADMINISTRATIVE CHARGE for neglect of duty that respondents are hereby found administratively liable of grave misconduct.

Resolution for the CRIMINAL CHARGE for there being a probable cause to indict respondents for violation of Section 3(e) of RA 3019 known as Anti-Graft and Corrupt Practices Act, as amended, let the corresponding information be filed with the Sandiganbayan.

The effect(s) on the Issuer's business or operations, if any

1. The OMBUDSMAN also took recognition of our properly executed purchase-sale of Mila Yap’s beach frontage parcel of 1,500 sq m.

2. In the final analysis, the passage of time shows Friday’s Holdings, Inc. own the property fair and square after paying the CAR.

4. RESOLUTION referring for filing of criminal charges and indicting for high probability of involvement in anti-graft and corrupt practices against the Municipal Assessor of Malay, Aklan and the Provincial Assessor of Aklan at the Sandiganbayan.
