MGA KASO KRIMINAL LABAN KINA GOV. MIRAFLORES AT ASAWA, DINISMIS NG SANDIGANBAYAN

DINISMIS NG Sandiganbayan ang mga kaso kriminal na isinampa laban kay Gov. Florencio Miraflores at asawa na si dating Ibajay mayor Lourdes Miraflores dahil sa inordinate delay.

Ang mag-asawang Miraflores ay kinusuhan dahil sa umano’y hindi wastong pagdeklara ng Statements of Assets, Liabilities, and Net Worth mula 2006 hanggang 2009. Sinasabing hindi nila idineklara ang pagmamay-ari ng ilang sasakyan at cash investment sa rural bank.

Subalit sa desisyon nitong Nobyembre 14 ipinunto ng Sandiganbayan 2nd Division na ang preliminary investigation stage lamang ay inabot na ng tatlong taon at tatlong buwan sa kabila ng "readily available" evidences.

Sinasaad na ang Section 3, Rule 112 of the Revised Rules of Court na ang Office of the Ombudsman ay dapat magsagawa ng preliminary investigation ng mga reklamo kriminal "more or less" 45 days.

"Applying the above-cited factors to these cases, it is evident that the constitutional right to the speedy disposition of cases of accused Florencio and Lourdes have been violated, hence the same should be dismissed," sinabi ng anti-graft court.

Nabatid na hindi ito ang unang kaso na dinismis ng Sandiganbayan dahil sa inordinate delay. Daan-daang kaso na ang naibasura kabilang ang mga high-profile kagaya ng mga kaso kaugnay ng fertilizer fund scam.##

GOBERNOR NG AKLAN AT ASAWA NAHAHARAP SA KASO KRIMINAL DAHIL SA MAANOMALYANG SALN

Nahaharap ngayon sa apat na paglabag ang gobernador ng Aklan na si Florencio “Joeben” Miraflores sa Sandiganbayan Second Division dahil sa maanumaliyang deklarasyon sa kanyang Statement of Assets, Liabilities and Net Worth (SALN).

Sinampahan siya ng mga paglabag sa Section 8 of R.A. 6713 o Code of Conduct and Ethical Standards for Public Officials and Employees kasama ang kanyang asawa na si dating Ibajay Mayor Ma. Lourdes Martin Miraflores base sa charge sheets na isinampa ni Graft Investigation and Prosecution Officer III Rachel T. Cariaga-Favila.

Mababatid na ang mag-asawang Miraflores ay nabigo na ideklara sa kanilang 2006, 2007, 2008 at 2010 SALN ang ilang ari-arian kabilang ang kanilang P6,160,000 investments sa Rural Bank of Ibajay, Inc., isang Isuzu Elf (RDJ867), isang Mazda pick-up (FCW954), isang Nissan Safari wagon with plate number TTF447, at isang Kawasaki motorcycle ( 062810).

Kabuuang Php120,000 ang itiakdang pyansa sa kanila o Php30,000 per breach of conduct charge.

Sa ilalim ng Section 8 of R.A. No. 6713, “public officials and employees have an obligation to accomplish and submit declarations under oath of, and the public has the right to know, their assets, liabilities, net worth and financial and business interests including those of their spouses and of unmarried children under eighteen (18) years of age living in their households.”/ source: Manila Bulletin
