Mayor Navarosa acquitted from criminal case filed by former college administator
LIBACAO, AKLAN - Mayor Charito I. Navarosa of Libacao, Aklan was acquitted from Criminal Case No. SB-13-CRM-0123, For: Unlawful Appointments (Article 244) of the Revised Penal Code by virtue of the decision rendered by the Sandiganbayan, 2nd Division last April 5, 2019.
The case was filed against him by Dr. Arturo I. Zonio, former College Administrator of the Libacao College of Science and Technology (LCST) at the Office of the Ombudsman Visayas for appointing Paterno D. Turang, Jr. as College Administrator of the Libacao College of Science and Technology (LCST) last July 11, 2011, in his capacity as the concurrent chairperson of the college.
The complainant accused him alleging that the appointee, Paterno D. Turang, Jr. was not qualified to the position as per Ordinance # 005-04, series of 2004, and that he was a losing vice mayoralty candidate in the May 2010 elections, where the appointment was made within the one year period after losing the elections, which is prohibited based on Section 6, Art. 1X-B of the 1987 Constitution, and other pertinent laws
The Sandiganbayan proclaimed that the accused Mayor Navarosa was "presumed to have acted in good faith when he depended upon the assurance of his subordinate."
The court further averred that the prosecution miserably failed to discharge its burden of establishing Mayor Navarosa's guilt beyond reasonable doubt.
Mayor Navarosa served as municipal mayor of Libacao, Aklan for 15 years and as vice mayor for 3 years. He was re-elected as municipal mayor of the same town in the recently-concluded national and local elections, and will continue to serve for another 3 years.
